Platform Terms

1. About Our Terms
1.1 These terms and conditions ("Terms") set out how you may use the tuck. website and the tuck. mobile application (together, the "Platform"). They form a legally binding agreement between Tuck Technology Limited ("we", "us" or "our") and you, the person accessing or using the Platform ("you" or "your").
1.2 Please read these Terms carefully before using the Platform. By creating an account or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Platform immediately.
1.3 If you download the tuck. app from the Apple App Store or Google Play Store, these Terms apply alongside any additional terms required by those platforms. In the event of conflict, the platform-specific terms will prevail only to the extent required by those platforms.
1.4 Our Privacy Policy governs how we collect, use, and store your personal data in accordance with the UK GDPR and the Data Protection Act 2018. Our Acceptable Use Policy sets out rules for appropriate use of the Platform. Both documents form part of these Terms.
2. About Us
2.1 We are Tuck Technology Limited (trading as "tuck."), a company registered in England and Wales under company number 12857517. Our registered office is at St Martins House, 7 Peacock Lane, Leicester, LE1 5PZ.

3. Eligibility and Registration
3.1 To use the Platform, you must:
(a) be at least 18 years old;
(b) be a UK resident;
(c) use the Platform solely on your own behalf; and
(d) provide accurate and complete registration information.
3.2 The Platform is intended for personal use only. If you are purchasing cashback cards or using the Platform for business purposes, your account may be subject to restrictions and different terms may apply. We reserve the right to limit or suspend your access if we determine that purchases are being made for commercial rather than personal use.
3.3 You are only entitled to hold one account. The legal owner of the email address and phone number used to register will be treated as the account holder.
3.4 We reserve the right to decline any registration or terminate any account at our discretion, including where we reasonably suspect fraud, misuse, or any breach of these Terms.
3.5 You are responsible for keeping your login credentials secure and for all activity carried out under your account. Please notify us immediately at support@tuckapp.co if you suspect any unauthorised access.
4. Identity Verification (KYC)
4.1 As part of our obligations to prevent fraud and financial crime, we may require you to complete identity verification ("Know Your Customer" or "KYC") at any point during your use of the Platform.
4.2 KYC verification is carried out by a third-party identity verification provider. You will be asked to submit:
(a) a valid form of photographic identification (such as a passport or driving licence); and
(b) a selfie or live facial image for the purpose of matching against your ID.
4.3 You must provide accurate, complete, and genuine information during the KYC process. Submitting false, misleading, or fraudulent documentation is a serious breach of these Terms and may result in immediate account termination and referral to the relevant authorities.
4.4 If you fail to complete KYC verification when requested, or if your identity cannot be verified to our satisfaction, we reserve the right to restrict your account, suspend cashback payments, or terminate your account entirely.
4.5 Data submitted during KYC will be processed in accordance with our Privacy Policy and the third-party provider's own privacy terms.
5. The tuck. App
5.1 The tuck. app is available to download free of charge from the Apple App Store and Google Play Store.
5.2 After downloading the app, you will need to register an account by providing the required details. You may optionally link a bank account using our Open Banking feature, provided by our third-party partner, Plaid.
5.3 Once registered, the app allows you to:
(a) discover cashback offers from our retail partners;
(b) purchase cashback cards for participating retailers; and
(c) browse retailer pages via the in-app shopping feature.
5.4 Earning cashback is always subject to the conditions set out in these Terms and our prior approval.
6. Cashback Cards
6.1 A cashback card is a digital gift card issued by tuck. that allows you to pay for goods or services at the specified retailer at the point of purchase. By purchasing a cashback card, you may be entitled to receive a cashback reward, the rate of which is specified at the point of purchase.
6.2 Before purchasing a cashback card, we strongly recommend that you review the relevant retailer's terms and conditions and any information displayed on the retailer's brand page within the app.
6.3 We may decline your order for a cashback card where:
(a) we are unable to verify that you meet the eligibility criteria;
(b) the cashback card is unavailable; or
(c) we suspect misuse or fraudulent activity.
6.4 Payment for your cashback card will be charged to your selected payment method at the point of order confirmation. The cashback card will be delivered digitally within the app, ordinarily within 2 minutes of confirmed payment.
7. Refund Policy
7.1 All cashback card purchases are final. We do not provide refunds once a cashback card has been issued, except where required by your statutory rights under applicable consumer law.
7.2 If you experience a problem with your cashback card, you must raise a support ticket with our team via the app or at support@tuckapp.co.
7.3 Any refund will only be considered at the sole discretion of both tuck. and the relevant retailer.
7.4 Where a refund is approved, please allow up to 14 days for the refund to be processed.
7.5 tuck. accepts no liability for a retailer's refusal to authorise a refund.
7.6 Nothing in this clause affects your statutory rights as a consumer under applicable UK law.
8. In-App Shopping
8.1 The in-app shopping feature allows you to browse participating retailers and visit their websites directly from within the tuck. app. In-app shopping is provided as a convenient browsing tool only.
8.2 No cashback rewards are earned through in-app shopping. Cashback rewards are only available when you purchase a cashback card.
8.3 tuck. acts solely as a facilitator providing access to retailer pages. Any purchase you make through in-app shopping is a direct transaction between you and the relevant retailer.
8.4 When using in-app shopping, you will be subject to the relevant retailer's own terms and conditions and privacy policy.
8.5 We reserve the right to add, remove, or amend the retailers available through in-app shopping at any time without notice.
9. Cashback Rewards
9.1 Cashback rewards are only earned through the purchase of a qualifying cashback card.
9.2 All cashback is subject to our approval. Our decision is final.
9.3 Your cashback balance reflects amounts that have been verified and approved by us. Funds displayed in your cashback balance are not your property until you have requested a withdrawal and the funds have been received into your nominated bank account.
9.4 We do not operate a custodial or banking service.
9.5 If your account is suspended or terminated for any reason, any outstanding cashback balance will be forfeited, subject to any rights you may have under applicable law.
9.6 We reserve the right to reclaim any funds paid to you in error.
10. Withdrawing Cashback
10.1 Once your cashback has been approved, you may withdraw your available balance as:
(a) a cash payment to your nominated UK bank account via BACS; or
(b) a gift card for a participating retailer.
10.2 To request a cash withdrawal, you must provide accurate bank details. If incorrect bank details are provided and funds are transferred to the wrong account, we may be unable to recover those funds.
10.3 You may only request one withdrawal per 24-hour period.
10.4 A minimum cashback balance is required before a withdrawal can be requested.
10.5 We may charge a bank transfer fee to cover processing costs.
10.6 We reserve the right to suspend withdrawal processing at any time if we reasonably suspect fraudulent or abusive activity.
11. Cashback Expiry and Account Inactivity
11.1 Standard cashback will expire 6 months from the date it is awarded if your account is inactive during that period.
11.2 "Inactivity" means that you have not made a purchase using a cashback card within any 6-month period.
11.3 If your account is deemed inactive, we reserve the right to remove any accrued cashback balance from your account.
11.4 Bonus cashback will expire 6 months from the date it is awarded if it has not been redeemed, regardless of account activity.
12. Bonus Cashback
12.1 From time to time, tuck. may run promotional campaigns offering bonus cashback rewards.
12.2 Bonus cashback is awarded on an individual user basis and will only be allocated once per user, unless otherwise stated.
12.3 Bonus cashback will typically be applied to your account within 48 hours of the qualifying action being completed.
12.4 We reserve the right to suspend, modify, or withdraw any bonus cashback offer at any time.
13. Voucher Codes
13.1 We do not guarantee the validity of any voucher code advertised on the Platform.
13.2 Using a voucher code in conjunction with a cashback card purchase may result in your cashback not being approved or processed.
14. Fraud Prevention and Account Security
14.1 If we reasonably suspect fraudulent, abusive, or dishonest behaviour, we reserve the right to:
(a) cancel outstanding cashback cards;
(b) suspend or block your account;
(c) withhold cashback payments; and
(d) terminate your account permanently.
14.2 If your account is suspended in error, you may contact our support team at support@tuckapp.co.
14.3 We may report suspected fraudulent activity to relevant authorities.
14.4 You must not use the Platform to engage in any unlawful activity.
15. Claims and Disputes Regarding Cashback
15.1 If you believe cashback has not been correctly credited, you may raise a claim by contacting us.
15.2 We will use reasonable endeavours to investigate your claim.
15.3 Our decision in relation to the approval or rejection of any cashback claim is final.
16. Complaints
16.1 We are committed to resolving complaints promptly and fairly. Please contact us at support@tuckapp.co.
16.2 We will:
(a) acknowledge your complaint within 5 business days;
(b) provide a full written response within 15 business days; and
(c) where this is not possible, send a holding response within 35 business days.
16.3 If you remain dissatisfied, you may be entitled to escalate your complaint through alternative dispute resolution.
16.4 Nothing in this clause affects your statutory rights as a consumer.
17. Changes to These Terms
17.1 We may update these Terms from time to time. Where we make material changes, we will give you at least 30 days' prior written notice.
17.2 We may make changes with immediate effect where required by law, regulation, or for reasons of security or fraud prevention.
17.3 If you do not wish to accept the updated Terms, you may close your account before the changes take effect.
18. Account Termination
18.1 You may close your account at any time by contacting us at support@tuckapp.co.
18.2 We may terminate your account immediately where we reasonably believe you have engaged in fraudulent or unlawful activity, committed a material breach of these Terms, provided false information, or acted in a manner that poses a risk to other users.
18.3 Where we wish to terminate for other reasons, we will give you at least 30 days' written notice.
18.4 Upon termination, any outstanding cashback balance will be forfeited unless clause 18.1 applies.
19. Using the Platform
19.1 The Platform is for your personal and non-commercial use only.
19.2 You are solely responsible for all costs and expenses incurred in connection with your use of the Platform.
19.3 The Platform is intended for use within the UK only.
19.4 As a condition of using the Platform, you agree not to introduce malicious software or attempt to gain unauthorised access.
19.5 We may suspend or terminate your access at any time if you breach these Terms.
20. Third-Party Services and Links
20.1 The Platform may contain links to third-party websites. We have no control over these sites and accept no legal responsibility.
20.2 We use certain third-party service providers to operate parts of the Platform, including Plaid for Open Banking connectivity.
21. Your Privacy and Personal Information
21.1 Your privacy is important to us. We handle your personal data in accordance with our Privacy Policy.
21.2 For the purpose of verifying transactions, we may share limited information with relevant retailers.
21.3 We may use an affiliate programme that involves sharing certain data with affiliated partners.
22. Intellectual Property
22.1 All intellectual property rights in the Platform and its content are owned by us or our licensors.
22.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal purposes.
22.3 You must not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.
23. Accuracy of Information
23.1 We take reasonable steps to ensure that the information on the Platform is accurate and up to date. However, we do not guarantee accuracy.
23.2 Content on the Platform is provided for general information purposes only.
24. Limitation of Liability
24.1 Nothing in these Terms limits or excludes our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any other liability that cannot be excluded or limited by law.
24.2 Subject to clause 24.1, we shall not be liable for any indirect or consequential losses, loss of profits, loss of data, or loss of anticipated savings.
24.3 Our total aggregate liability shall not exceed £100 or the total amount paid by you in the 12 months preceding the claim, whichever is greater.
25. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.
26. General
26.1 These Terms constitute the entire agreement between you and us.
26.2 If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
26.3 No failure or delay by us in exercising any right shall constitute a waiver of that right.
27. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
